1. Acceptance of Terms

By accessing or using KNTK's website, mobile application, or services (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not access or use our Services.

KNTK reserves the right to modify these Terms at any time. We will notify users of material changes via email or through our Services. Your continued use of the Services after changes are posted constitutes acceptance of the modified Terms.

2. Description of Services

KNTK provides:

Access to training programs, breathing protocols, and educational content
Mobile and web-based applications for performance optimization
Assessment tools and personalized protocol recommendations
Optional one-on-one coaching services (subject to separate agreements)

All Services are provided "as is" and "as available" without warranties of any kind, either express or implied.

3. User Accounts and Registration

Account Creation:

You must provide accurate, current, and complete information during registration
You are responsible for maintaining the confidentiality of your account credentials
You agree to notify KNTK immediately of any unauthorized access to your account
You must be at least 18 years of age to create an account

Account Responsibility:

You are solely responsible for all activity that occurs under your account
KNTK is not liable for any loss or damage arising from your failure to maintain account security

4. Subscription and Payment Terms

All-Access Membership:

Monthly subscription fee of $30/month (or current pricing)
First week free trial for new members
Automatic renewal unless cancelled
Payment processed via secure third-party payment processors

Billing:

You authorize KNTK to charge your payment method on a recurring basis
Subscription fees are non-refundable except as required by law
Price changes will be communicated at least 30 days in advance
Failed payments may result in service suspension or termination

Cancellation:

You may cancel your subscription at any time through your account settings
Cancellation takes effect at the end of the current billing period
No refunds for partial months or unused access
Access continues until the end of the paid period

5. Intellectual Property Rights

Ownership: All content, materials, programs, protocols, videos, text, graphics, logos, and software provided through the Services are the exclusive property of KNTK or its licensors and are protected by copyright, trademark, and other intellectual property laws.

Limited License: KNTK grants you a limited, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes only.

Restrictions: You may not:

Copy, modify, distribute, or create derivative works from our content
Use our content for commercial purposes
Remove copyright or proprietary notices
Reverse engineer or attempt to extract source code
Share your account access with others
Record, download, or redistribute program content without written permission

6. User Conduct and Prohibited Activities

You agree not to:

Violate any applicable laws or regulations
Harass, threaten, or harm other users
Upload viruses or malicious code
Attempt to gain unauthorized access to our systems
Use automated systems (bots, scrapers) without permission
Impersonate KNTK staff or other users
Share false or misleading information
Use the Services in any way that could damage our reputation

7. Health and Medical Disclaimers

Not Medical Advice: The information, programs, and protocols provided by KNTK are for educational and informational purposes only and do not constitute medical advice, diagnosis, or treatment.

Consultation Requirement: You should consult with a qualified healthcare provider before:

Beginning any new exercise or breathing program
Making changes to your current training regimen
If you have any pre-existing medical conditions
If you experience pain, discomfort, or adverse reactions

Assumption of Risk: Physical training and breathing exercises involve inherent risks. By participating in KNTK programs, you acknowledge and accept these risks. You agree to participate at your own risk and release KNTK from liability for injuries or health complications.

Individual Results: Results may vary. KNTK makes no guarantees regarding specific outcomes, performance improvements, or health benefits.

8. Limitation of Liability

To the maximum extent permitted by law:

KNTK shall not be liable for:

Indirect, incidental, special, consequential, or punitive damages
Loss of profits, data, use, or goodwill
Service interruptions or technical failures
Injuries or health complications arising from program participation
Actions or content of third-party services or users

Maximum Liability: KNTK's total liability shall not exceed the amount you paid to KNTK in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify, defend, and hold harmless KNTK, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

Your use of the Services
Your violation of these Terms
Your violation of any rights of another party
Your participation in training programs

10. Third-Party Links and Services

Our Services may contain links to third-party websites or integrate with third-party services. KNTK is not responsible for:

The content, accuracy, or practices of third-party sites
Privacy policies of external services
Transactions conducted with third parties

Your use of third-party services is at your own risk and subject to their terms and conditions.

11. Termination

By You: You may terminate your account at any time by cancelling your subscription.

By KNTK: We reserve the right to suspend or terminate your access immediately, without notice, for:

Violation of these Terms
Fraudulent or illegal activity
Abusive behavior toward staff or other users
Non-payment of fees
Any reason at our sole discretion

Effect of Termination: Upon termination, your right to access the Services ceases immediately. Provisions regarding intellectual property, disclaimers, limitation of liability, and indemnification survive termination.

12. Dispute Resolution

Governing Law: These Terms are governed by the laws of California, USA, without regard to conflict of law principles.
